Canadian Levofloxacin Patent Upheld by Federal Appeal Court

The Canadian Federal Appeal Court affirmed the decision of the Canadian Federal Court which ruled that Daiichi Sankyo's patent for levofloxacin (LEVAQUIN) is valid and infringed by generic version of levofloxacin tablets of Novopharm Limited.

The Canadian Federal Court ruled on October 17, 2006 that the patent for levofloxacin (LEVAQUIN) held by the Daiichi Sankyo Co., Ltd. is valid and infringed by the manufacturing and selling by Novopharm Limited of generic version of levofloxacin tablets. On June 7, 2007, the Canadian Federal Appeal Court dismissed the appeal made by Novopharm, and thus, Novopharm is prevented from making, using, offering to sell, or selling a generic version of levofloxacin tablets in the Canadian market from November 16 until the expiration of patent on June 23, 2009. Daiichi Sankyo granted an exclusive license to Johnson & Johnson to make, use, and sell pharmaceutical preparations containing levofloxacin in Canada with the right of sublicense. Janssen-Ortho Inc. is the exclusive sub-licensee for levofloxacin tablets in Canada. Janssen-Ortho Inc. markets levofloxacin tablets in Canada under the trade name LEVAQUIN.
